1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of Peekd, including getpeekd.com and the Peekd dashboard (together, the "Service"), operated by Peekd ("we," "us," "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you don't agree, please don't use the Service.

2. The service

Peekd connects to your Gmail or Outlook account to help you know when emails you send are opened, clicked, or replied to, and to suggest AI-assisted follow-ups. We may add, change, or remove features at any time, and we'll do our best to give notice of material changes.

3. Your account

You must provide accurate information when creating your account and keep it up to date. You're responsible for all activity that happens under your account and for keeping your login credentials secure. Notify us immediately at hello@getpeekd.com if you suspect unauthorized use of your account.

4. Acceptable use

Peekd is a tool for tracking and following up on emails you send to people you already have a relationship with. When you use Peekd, you agree that you will not:

  • Send unsolicited bulk email, spam, or messages to recipients who have not agreed to hear from you, or to lists purchased, scraped, or otherwise acquired without consent.
  • Use Peekd to send content that is deceptive, fraudulent, phishing, malicious, or that violates applicable anti-spam laws (including CAN-SPAM, CASL, or GDPR e-privacy rules).
  • Use the Service to harass, defame, or violate the rights of any third party.
  • Attempt to gain unauthorized access to Peekd's systems, other users' accounts, or interfere with the Service's normal operation.
  • Reverse-engineer, resell, or use the Service to build a competing product without our written permission.
  • Violate the terms of service of Gmail, Google Workspace, Outlook, or Microsoft 365 while using Peekd with those accounts.

We may suspend or terminate accounts that violate this section, with or without notice.

5. Subscriptions & billing

Peekd offers a Free plan and a paid Pro plan, billed monthly or yearly. By subscribing to Pro, you authorize us (or our payment processor) to charge your payment method on a recurring basis until you cancel. You can cancel anytime from your account settings; cancellation takes effect at the end of your current billing period, and we don't offer partial refunds for unused time except where required by law.

Prices may change; we'll give you notice before any change applies to your subscription.

6. Intellectual property

Peekd and its original content, features, branding, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws. Content you send through Peekd (your emails) remains yours — using Peekd doesn't transfer any ownership of it to us.

7. Privacy

Our Privacy Policy explains how we collect, use, and protect your data, including data accessed through the Gmail API, and is incorporated into these Terms by reference.

8. Termination

You may stop using Peekd and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, misuse the Service, or if required to comply with legal obligations or requirements from our infrastructure or payment partners (including Google, Microsoft, or our payment processor).

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including — but not limited to — implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that tracking data (opens, clicks) will be 100% accurate, as email clients and networks can affect detection.

10. Limitation of liability

To the maximum extent permitted by law, Peekd will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose.

11. Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll notify you by email or through the dashboard. Continued use of the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by applicable law in the jurisdiction where Peekd is established, without regard to conflict-of-law principles.
